The six (6) hour Real Estate Law and Regulations module has been developed to provide real estate licensees with a thorough understanding of Virginia laws and regulations governing brokerage operations, property transactions, and professional conduct. Upon completing the course, students will be able to discuss supervising broker duties, brokerage advertising rules, escrow account maintenance, and violations of the law. They will also understand the Virginia Real Estate Transaction Recovery Fund, misrepresentation, the Residential Property Disclosure Act, contract termination, the Virginia Residential Landlord and Tenant Act, Property Owners Association and Condominium Act requirements, flood risk disclosure rules, and Common Interest Community (CIC) board and licensing regulations.

Furthermore, students will be able to discuss the essentials of an enforceable contract, distinguish between bilateral and unilateral agreements and describe the various remedies for breach of contract.

Students will also learn about the scope of authority agents possess depending on their relationship with a customer or client, the important terms within the Virginia Code and the types of agency relationships permitted by law in the State of Virginia. The course also provides a necessary overview of the “Guidance Document on Necessity for Brokerage Agreements” and its purpose.

Upon completing the module, they will be able to explain how niche marketing benefits brokerages and clients and identify the various guidelines that should be followed when implementing social media marketing. Furthermore, this module aims to inform students about digital security and online safety. Students will be able to discuss and identify methods of protecting their clients’ information and inform clients on the dangers of identity theft and the various methods used.

Upon completing the module, students will be able to describe the reconciliation requirements of Brokerage accounts, identify improper maintenance, recordkeeping, and delivery violations, and define commingling and conversion of funds. Furthermore, they will thoroughly understand Virginia rules and deadlines for depositing trust monies and how to calculate the broker trust liability.
